Man accused in NYC subway chokehold death to face manslaughter charge



The man accused of putting another man in a chokehold on the New York City subway is now facing manslaughter charges. Daniel Penny turned himself into the NYPD today. NBC's Lindsay Reiser has a closer look at the case. 24 year old former Marine Daniel Penny surrendered to the fifth precinct this morning and then was taken in an unmarked car. The back of this building is courthouse in lower Manhattan where he'll face a manslaughter in the second degree charge. This is punishable by up to 15 years in prison and is recklessly causing the death of another. Back on May 1st, Jordan Neely, who had been experiencing homelessness, was a subway performer.

According to witnesses was yelling at other passengers on that subway car saying, I'm hungry, I'm ready to die. And that is when witnesses say Penny subdued him with that lethal chokehold. Now attorneys for Neely's family say he was loved and supported but he battled demons. He had experienced tragedy early on in his life but they showed a picture of him in a graduation cap saying this could be any one of us. As for Penny's attorneys, they say that he was acting. He risked his own life and safety for the good of his fellow passengers. Back to you.
